- Majority-group plaintiffs are not expected to meet a heightened evidentiary standard to support a Title VII disparate treatment claim.
- The Texas Commission on Human Rights Act (TCHRA) does not foreclose common law torts claims brought by an employee against another employee.
- The Texas Department of Insurance Division of Workers’ Compensation does not have exclusive jurisdiction over the determination of whether an employee’s injury was work-related in certain circumstances.
